National Managing Surveyor
Job Introduction
We are currently looking for a National Managing Surveyor to join our team based in Solihull. In this role you’ll work closely with colleagues in the national and regional teams to secure major contracts for Tarmac having negotiated the most favorable terms whilst also working in parallel to reduce exposure to business risk.
The successful candidate will also lead the negotiation of terms and conditions on contracts of significant national importance, typically between £10m and £120m in value, so it’s vital that you have proven experience at this level, can challenge when and where required and collaborate to achieve the desired outcome.
Additionally, you can expect to be responsible for providing an expert opinion, leadership, guidance and direction across Tarmac on all complex commercial bids, contracts and disputes.
Role Responsibility
In this role you will be responsible for a number of tasks including:
- Leading the commercial review of the contract conditions on all national major project tenders by working closely with the legal team to provide an expert legal and commercial evaluation of contract terms and risk
- Leading the pricing of national major project tenders, managing mid tender reviews, price finalisation and tender sign off with regional MD's and their teams
- Leading the (re)negotiation of terms and conditions on contracts of significant national importance, working closely with stakeholders including business leaders, legal, finance and insurance colleagues and in accordance with the rules of business
- Providing an expert opinion on the provision of parent company guarantees, advance payment bonds, asset development agreements, CRH Capex submissions and/or other complex contract requirements
- Ensuring that business risk is removed or mitigated at all stages of the commercial process from bids to agreement of final account
- Working closely with procurement to manage the appointment of key sub-contractors and negotiation of contract conditions
- Providing contractual expertise to directors, quantity surveyors, commercial, financial and operational colleagues across Tarmac to ensure maximum financial returns on all contracts
- Supporting the recruitment of commercial staff for major projects where appropriate and facilitate handover to area delivery teams
- Providing expert opinion and, where necessary taking the lead in handling complex and varied contractual disputes across Tarmac
- Identifying and implementing best practices across the national business and acting as a key decision maker in the national commercial strategy
- Securing payments from customers within the specified contract terms and offering proactive advice on commercial risk
- Driving and delivering best practice relating to the effective management of all financial and contractual processes at all stages of the major project process
The Ideal Candidate
The ideal candidate will have a proven commercial background that is supported by a relevant degree and/or professional qualification or equivalent experience. You’ll have significant practical experience of high-level contract negotiations with national customers, main contractors and supply chain. You’ll also know how to approach and resolve any associated legal disputes and be familiar with the resolution process. Your comprehensive knowledge and experience of all major forms of construction contracts and price review mechanisms should be supported by the roles you have undertaken previously. If you are familiar with legal and tax/CIS legislation and requirements then that is advantageous too.
You should be able to demonstrate your expertise in developing collaborative relationships both internally and externally and be able to easily transfer this to your own team/department by building team spirit and trust in a positive working environment. As a senior leader you will be a highly experienced and effective communicator and negotiator who is at ease with major customers and also supply chain stakeholders discussing and negotiating agreement of prices or contract terms and, where necessary for contract dispute resolution.
If you have experience of implementing process improvement to mitigate risks that would be most welcome as would your drive to proactively overcome obstacles to meet challenging, and sometimes changing objectives.
Importantly you’ll be confident in your approach and be comfortable operating at the highest level when representing the business in contractual negotiations and be able to flex your thinking style to suit the situation to achieve the desired outcome.
